Such a representative needs to be defined by the controller responsible for data processing. According to Section 44 of the German Data Protection Act (BDSG), this representative is also an authorised recipient for notifications in civil-law proceedings concerning legal actions due to an infringement of data protection provisions.

The representative must be based in one of the member states in which the data subjects, whose data is processed or whose behaviour is observed, are located. They need to be appointed in writing. Failure to appoint a representative despite this legal obligation can result in severe fines.
